Bikkembergs E-store is owned and operated by International Fashion Factors IFF (IFF sàrl) and is the only official Bikkembergs online store. Some other websites might also offer a selection of Bikkembergs items but have no ties to our Group. 1.1. There is a valid agreement between you (“the Customer”) and IFF sàrl (IFF) upon the receipt of the confirmatory e-mail set out in article 3.1 (“the Agreement”). The Agreement will be governed by these terms and conditions. 1.2. The products and services on this website are delivered or made available only within the European Union. 1.3. The products and services on this website are only delivered or made available to natural persons.
2.1. The prices listed in the Bikkembergs E-store are in Euro and include VAT. They do not include delivery charges (which will be added during checkout), import taxes and insurance. 2.2. IFF cannot be held liable for typing errors with regard to the prices. Only the price stated in the confirmatory e-mail is correct. 2.3. Prices are subject to changes. The Customer will be billed the price stated in the Bikkembergs E-store at the time the order was made. 2.4. Notwithstanding article 3.3, the Customer must pay the applicable price at the moment he makes the order. 2.5. For all purchases information, the Bikkembergs E-store uses industry-standard encryption technology, providing an encrypted channel and server authentication. In this way, all information is transmitted through a secured server connection. As a result, information transmitted on-line is only available to the Bikkembergs E-store. While we use encryption to protect sensitive information online, we also protect user information off-line.
3.1. A confirmatory e-mail will be sent shortly after the order has been processed. 3.2. The goods will be delivered by a third party. IFF cannot be held liable for any late deliveries or items damaged, lost or stolen during delivery. The Customer shall carry the risk to the goods as of the delivery. IFF shall retain title to the goods until full payment of the goods by the Customer. 3.3. The Customer shall have the right to communicate to IFF that he withdraws from the purchase, without having to pay a penalty and without having to give any reason, within seven working days from the day that follows the delivery of the product. The Customer bears all costs related to the return of the goods to IFF including, but not limited to loss, theft and damage during transport. 4.1. All products and services made available on or through the Bikkembergs E-store are provided on an “as is” basis. The pictures and narratives may not give a full accurate description of certain aspects including, but not limited to, the colour tint. IFF cannot be held liable for such inaccuracies. 4.2. IFF will regularly update the list of the items pursuant to their availability. However, all products and services made available in or through the Bikkembergs E-store are provided on an “as available” basis. IFF may, regardless of the confirmatory e-mail, cancel the order in case the items are no longer available. In such case, IFF will issue a full credit to you. 4.3. IFF cannot be held liable for any direct and indirect damage arising out of or related to the use of the Bikkembergs E-store including, but not limited to, a failure to process the order for technical reasons, unless such damages are due to the fraud or gross negligence of IFF. 4.4. IFF cannot be held responsible for any website linked to the Bikkembergs E-store. Any such website is independent from the Bikkembergs E-store. The Bikkembergs E-store has no control over, nor responsibility with respect to, the information provided or activities undertaken by any such website. 4.5. IFF shall not be held liable or deemed to be in default for any delay or failure in performance of any obligation under the Agreement resulting directly or indirectly from force majeure. The term force majeure shall include war, terrorist acts, civil disturbance, fire, flood, unorganised strike, acts of governmental authorities, acts of God or any other causes or conditions beyond IFF’s reasonable control.
5.1. You agree that you are prohibited from posting or transmitting to the Bikkembergs E-store website any material that could give rise to any civil or criminal liability under the law. The Bikkembergs E-store reserves the right to seek all remedies available at law and in equity for violations of the Agreement, including the right to block access from a particular internet address to this website.
6.1. IFF shall remain the sole owner of all property rights on the content appearing on the website including, but not limited to, trademarks, trade names, graphics, logos, images, text, audio clips, icons, and computer software. You are only allowed to use the Bikkembergs E-store site for its intended purpose, which is for your retail use only as a consumer. Any other use of content from this website is strictly prohibited. Unless approved in advance and in writing, IFF prohibits any links to other websites. Registered and unregistered proprietary information is owned and held by IFF. Misuse of this website in any form may lead to legal action to the fullest extent.
7.1 IFF reserves the right to terminate your access to our website at any time and at our sole discretion.
8.1 If you are a minor under 18, you can use this service only under the supervision of your parents or guardians.
9.1 You agree that the Agreement is governed by the laws of Luxembourg. In addition, you agree to the exclusive personal jurisdiction and venue of the Luxembourg courts.
10.1 Articles 2, 3, 4 and 6 of the Agreement shall survive the termination of the Agreement for a period of 5 (five) years. 10.2 If any provision of the Agreement is invalid, illegal or incapable of being enforced by any rule or law, or public policy, all other conditions of the Agreement will remain in full force and effect. 10.3 IFF reserves the right to revise the terms and provisions set forth above at any time. All revisions will be published on the website and communicated to the Customer via e-mail.
Specific Sales Conditions: Events By using our DIRK BIKKEMBERGS event service, you accept that the conditions in this section apply to your purchase of entry tickets for that event.
1.1 When we receive your payment, we will send you an e-mail that will be your electronic ticket. Please print this ticket and bring it with you in order to get access to the event. 1.2 The ticket is only valid for the event, the date and the people mentioned on the ticket. It is a unique ticket with a unique code that cannot be duplicated.
2.1 If the event is a charitable event, you do not have the right to withdraw from the purchase of the ticket. 2.2 We do not refund, replace or exchange tickets. Only if the event organizer cancels the event, you will get a refund.
3.1 The event organizer reserves the right to deny access or remove you from the event if this is necessary for the smooth operation of the event. You will have to comply with all safety regulations and reasonable directions that the event organizer may give. 3.2 The event organizer and we are not responsible for damage, loss or theft that may occur at the event unless in case of negligence or willful misconduct. 3.3 The event organizer may take pictures and make audiovisual recordings of the fashion show. Consequently, you may be photographed or filmed during this event and the event organizer may use the results for commercial purposes.
4.1 It is not permitted to resell the tickets or to use them for commercial or promotional purposes. 4.2 It is not permitted to reproduce the tickets. We will undertake legal actions against counterfeiting of tickets.
5.1 All General Terms and Conditions of Sale mentioned on this website apply, except art. 3.2. and 3.3.
Specific Sales Conditions: Gift Vouchers By using our DIRK BIKKEMBERGS gift voucher service, you accept that the conditions in this section apply to your purchase of a DIRK BIKKEMBERGS gift voucher. 1. Gift vouchers that you purchase on our website can be used for an unlimited time to pay for the products that we offer for sale via this website. 2. We will send your gift voucher as soon as your payment has been cleared or on the delivery date that you requested (if this is later). 3. To buy a product with a gift voucher, you will have to use the unique offer code set out in the gift voucher. The amount set out in the gift voucher will be deducted from the order amount during the check-out. If the gift voucher value is higher than the order amount, the balance will not be credited but you will automatically receive a new offer code for the balance to purchase additional products next time. 4. Per single order (of one or more products) you can redeem only one gift voucher. Gift vouchers cannot be used in combination with other promotional offers for which you are using an offer code. 5. We are not responsible if a gift voucher is not delivered to the recipient’s email address because of errors in the delivery e-mail address entry, spam filters, firewalls, the capacity of the recipient’s mailbox or any other factors that are beyond our control. 6. If after delivery of the gift voucher, the voucher is lost, stolen, deleted or used by a party who is not the recipient, we will not refund, replace or exchange it. Please make sure that the recipient has received his/her gift voucher. 7. If the recipient uses a gift voucher to buy products, these products cannot be refunded. Instead, upon request, we will provide the recipient with a gift voucher equal to the value of the returned goods. With this new gift voucher, it will be possible to buy other products. This new gift voucher will not be refunded either. All General Terms and Conditions of Sale mentioned on this website apply, except art. 3.2. Art. 3.3. shall apply only if the request to withdraw from the purchase of the gift voucher is made before the gift voucher is used. In the other event, article 7 of these specific conditions shall apply. |
